RULES & REGULATIONS .

FOUNDATION OF MIRA BHAYANDER PROPERTY DEALERS ASSOCIATION is a non-profit organization formed by 10 (TEN) leading real estate Associations based in MIRA BHAYANDER.

These Associations have been catering to Multinational/Indian corporations / individuals in the areas of commercial - retail and residential real estate consulting.

The main aim and objective of FMBPDA is to promote ethical values and standard business practices in real estate consulting across MUMBAI & MMR to educate and build successful real estate consultants/ agents. Thus bringing all the real estate consultants on a common platform with one GOAL -- Setting the highest and most ethical standards and practices in the field of real estate consulting. The members of Associations have successfully managed to run organized real estate brokerage/ consulting firms organized market over the years and have practiced ethical and corporative methods amongst the fellow consultants, thus making real estate consulting/ brokerage business a reputable and respected business practice across Mumbai.

FMBPDA was formed in April 2014 and registered with Office of Charity Commissioner, Thane, vide registration Number MAH/854/24/THANE. Ever since its formation has made remarkable achievements. FMBPDA is Affiliated with CREBAI (Confederation of Real Estate Brokers Association of India) thus bringing FMBPDA on the State and national platform in a very short span of time.

  • To maintain high and ethical standards of professional services in the Real Estate Profession.
  • To establish a centre for interaction amongst its members and clients and to promote business as per the high industry standards based on code of ethics.
  • To establish committee/s for better ways of providing services to the clients and try to resolve any disputes in the trade of real estate consulting.
  • To standardize business practices in real estate consulting trade.
  • To establish a "code of ethics" to monitor the Associations and its member's business, behavior and practices.
  • To create a dispute resolution cell (Grievance Cell) for members.
  • To protect, promote and consider measures for the protection, promotion and a ancement of the trade and business in Mira Bhayandar.
  • To support and protect the standard trade and to promote practices and prevent/suppress malpractices, if any, and to promote co-operation between all persons engaged in the business of Real Estate Brokering in Mira Bhayander and all other areas as may be decided from time to time.
  • To encourage and develop meaningful co-operation amongst persons engaged in thebusiness of Real Estate Agency/ Brokerage and related services trade, directly or indirectly irrespective of caste, colour or creed, on all subjects connecting with and involving their common goal.
  • To institute encourage, develop and progress all kinds of methods and guiding factors relating to the Real Estate consulting Trade.
  • To undertake short term training programs for the members of Association with regards to the skill of tested techniques and to exchange new ideas to solve challenging problems to educate the members or persons related to the real-estate consulting trade in the methods principles and standards to be maintained of the trade and in general to acquire a more enlightened perspective on Real Estate matters.
  • To conduct conferences, seminars, demonstrations, programs, exhibitions etc with a view to disseminating the knowledge and techniques of Real Estate investment and asset management, so that it would help the community of people involved to render better services with standard prescribed by the FMBPDA.
  • To convene when thought necessary or expedient, conferences, seminars, exhibitions, or meetings at such places and at such times as considered desirable so as to further the objects of its members.
  • To collect, classify and circulate statistical and other information and to undertake special enquiries whenever necessary on all matters relating to the Real Estate profession which will be beneficial and important for establishing high standards in the trade and profession for which the Associations will be striving to achieve with regards to its pursuit.
  • To take all steps which may be necessary for promoting, supporting or opposing any legislation affecting the interests of the Real Estate profession by any local body.
  • In general to take the initiative and/or join in taking any collective action to secure protection and development of the Real Estate Agency profession in all respects.
  • To make representations to Central or State Governments or local or public or semi- public authorities, executive or legislative in future on any matter directly or indirectly affecting the Real Estate profession.
  • To communicate with Associations and concert and promote adopt measure for the protection and/or development of the Real Estate profession.
  • To ensure that all members of the Association co-operate with each other and follow the Rules and Regulations laid down by the FMBPDA.
  • To settle disputes among members arising out of members any Association through proper channel violating the Rules and Regulations laid down by the FMBPDA.
  • To provide a forum for the settlement of disputes between the members and clients and members.
  • To provide a platform for interaction amongst members to exchange their views and ideas.
  • To insure and arrange insurance cover for, and to indemnify its members, and those of its members from and against, all such risks occurred in the course of the performance of their duties as may be thought fit.
  • To amalgamate with any associations which are charitable at law and have objects altogether or mainly similar to those of the FMBPDA by this memorandum of association. Such Association should have minimum 50 members with prescribed fees paid by its members and with Audited accounts. Should have registered at least One year before the period of amalgamation or absorbing as member to the FMBPDA.
  • Henceforth, all the Associations affiliated to FMBPDA shall have to take prior approval from the FMBPDA for any resolutions pertaining to Business ethics.
  • To act as mediators, arbitrators and surveyors and arrange for arbitration in all matters of disputes, differences or claims in relation to the aforesaid matters or connected with the members of the Real Estate.
  • And generally to do all other lawful things as are incidental or conducive to the attainment of the objects of the Associations or any of them.
  • CANCELLATION OF MEMBERSHIP:

  • (a) On death of the member
  • (b) On resignation and on acceptance thereof with majority.
  • (c) On being terminated for any reason
  • (d) Due to unsound mind, crime, corruption or illegal practices
AMENDMENTS ALTERATION AND ADDITION TO THE RULES AND REGULATIONS OF THE FOUNDATION:

Any amendments, alteration and addition to these rules may be made by resolution passed by a majority of the managing committee members according to the provisions Rules 12 & 12A of Societies Registration Act 1860.

TENURE:

Tenure of work of the Elected Committee shall be for THREE YEARS; it shall be elected by secret Ballot at the Annual General Body Meeting convened for the purpose of the election of New Committee.In case of resignation, death etc, of

Elected Members, The Committee should appoint a care taker by calling Emergency Meeting and call for Special General Body Meeting to elect New Committee within the members.

The Elected Committee i.e. President, Secretary & Treasurer shall have all right to run the organization smoothly.

The President, Secretary & the Treasurer shall have the power of expenditure up to Rs. 10,000/= without the approval of the Committee. However, such expenses shall be brought to the notice of the members in review meetings.

Right to help the people affected by natural calamities or needy people by approving in the Committee Meeting.

Any appointments, approvals or major decisions must be approved by the Committee meetings with the majority.

Any such decisions, approvals, resolutions passed in the meeting will be final and binding to all the members of the FMBPDA.

“ANNUAL GENERAL BODY” means all the Committee Members of the Associations affiliated to the FMBPDA. All the Committee Members shall have right to attend the AGM but will not have rights to vote.
